Purpose and Scope of Application<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">This Legal Notice regulates the access, browsing, and use of the Academy's website. The status of User is attributed to any person who accesses, browses, or interacts with this website. <\/p>\n\n<p class=\"wp-block-paragraph\">Access to or use of the website or any of its pages implies the full, express, and unreserved acceptance of each and every condition included in this text. If the User does not agree with these conditions, they must leave the website immediately. <\/p>\n\n<h2 class=\"wp-block-heading\"><a><\/a>3. Conditions of Access and Use of the Website<\/h2>\n\n<p class=\"wp-block-paragraph\">Access to the website is open and generally free of charge, without prejudice to the membership fees and accreditation mechanisms regulated in the Statutes and the Internal Regulations (RRI) for access to the Private Area and the exercise of the rights of full and associate members.<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Proper use and obligations of the User:<\/strong> The User undertakes to use the website, its contents, forums, and services in accordance with the law, morality, these terms, the Statutes of the entity, and public order. The User is obliged to make diligent, correct, and lawful use of the services, refraining from using them for their own commercial or personal profit-making purposes without the express authorization of the Board of Directors. <\/li>\n\n\n\n<li><strong>Specific prohibitions and technical security<\/strong>: The use of the website for unlawful or harmful purposes, or in any manner that may overload, damage, disable, or impair the normal operation of the platform, is strictly prohibited. By way of example, but not limitation, the User undertakes to: \n<ul class=\"wp-block-list\">\n<li>Not to introduce, store, or distribute computer programs, data, computer viruses, malicious code (<em>malware<\/em>), or any logical or physical device capable of causing alterations or damage to the computer systems of the Academy, its providers, or third parties.<\/li>\n\n\n\n<li>Not to perform reverse engineering, decompilation, or disassembly of the technological elements, scripts, source codes, or online assembly and voting platforms of the entity.<\/li>\n\n\n\n<li>Not to use automated systems, robots, <em>spiders<\/em>, or <em>web scraping <\/em>mechanisms to extract information, content, or contact details from the database.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Private Member Area and Access Credentials<\/strong>: For access to certain restricted areas, the exercise of voting rights, or participation in internal debates, the User must use the credentials linked to their official email. The User is solely and exclusively responsible for maintaining the confidentiality and custody of their access keys, which are personal, confidential, and non-transferable. Any action or vote carried out under these credentials will be directly attributed to the registered User, who will be liable for any damages resulting from negligent use or the loss of control thereof.  <\/li>\n\n\n\n<li><strong>Infringements and reputational damage<\/strong>: In the event that the User breaches the provisions of this section, the Academy reserves the right to immediately suspend, limit, or revoke their access to the website, without prejudice to the initiation of the corresponding disciplinary proceedings if the individual is a member (for committing serious or very serious offenses involving attacks on the organization's image, fraud, or lack of respect, in accordance with articles 14 and 15 of the Internal Regulations [RRI]) and the exercise of any civil or criminal legal actions that may correspond by law.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><a><\/a>4. Intellectual and Industrial Property<\/h2>\n\n<p class=\"wp-block-paragraph\">The Academy is the owner or holds the relevant exploitation rights, authorizations, and licenses for all intellectual and industrial property rights of this website, including, but not limited to, the source code, software, algorithms, graphic design, user interface, texts, logos, trademarks, graphics, illustrations, photographs, and multimedia elements. In light of the foregoing, Users must respect the following rules regarding the intellectual and industrial property included on the website in accordance with these conditions. <\/p>\n\n<p class=\"wp-block-paragraph\">Given the Academy's foundational purpose to '<em>give voice, structure, promote, document, and preserve the works and tools of the Digital Arts sector'<\/em> (Art. 3 and Art. 4 of the Statutes), it is expressly stated that all digital performing arts, digital sound art, algorithmic experimentations, generative art, <em>live coding<\/em>, data art, <em>net art,<\/em> artistic robotics, immersive experiences, and light arts displayed, indexed, or archived on this platform are strictly protected by the copyright and intellectual property rights of their respective creators.<\/p>\n\n<p class=\"wp-block-paragraph\">The reproduction, distribution, transformation, modification, public communication, making available, or any other form of exploitation, in whole or in part, of any of the materials and contents of the website is strictly prohibited without the express, prior, and written authorization of the corresponding right holder or the Academy, as applicable. Access, browsing, or use of the website by the User does not, under any circumstances, imply a waiver, transmission, license, or total or partial assignment of these rights. <\/p>\n\n<p class=\"wp-block-paragraph\">The Academy, on its own behalf and on behalf of the artists and full members who exhibit their works on this website, expressly reserves the <strong>text and data mining<\/strong> rights regulated in Article 4 of Directive (EU) 2019\/790 on copyright in the Digital Single Market. The use of the contents of this website (<em>artistic works, codes, images, texts, or databases<\/em>) for the training of artificial intelligence models, machine learning, or automated reproduction is completely prohibited without a specific contractual agreement and prior written license. <\/p>\n\n<p class=\"wp-block-paragraph\">If any User or third party considers that any of the content hosted on the website infringes their intellectual property rights, they must immediately notify the Academy's official contact email address, providing the identification of the right holder, a description of the infringing content, and documentation proving ownership, in order to proceed with its review and precautionary removal if applicable.<\/p>\n\n<h2 class=\"wp-block-heading\"><a><\/a>5. Exclusion of Liability<\/h2>\n\n<p class=\"wp-block-paragraph\">The Academy applies the standard market technical, organizational, and technological security measures in accordance with the current applicable regulations in each case, but cannot guarantee the infallibility of the internet nor the total absence of harmful elements maliciously introduced by external third parties.<\/p>\n\n<p class=\"wp-block-paragraph\">Therefore, the entity disclaims and excludes all liability for damages of any nature arising from:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Availability and Continuity:<\/strong> The lack of availability, connection errors, service interruptions, server crashes, maintenance, or technical malfunction of the website or its asynchronous assembly and voting tools.<\/li>\n\n\n\n<li><strong>Harmful Elements and Intrusions:<\/strong> The existence of malicious software (<em>malware<\/em>), viruses, Trojans, or harmful programs in the content that may cause alterations or damage to the User's <em>hardware<\/em> or <em>software<\/em>, or to their digital files, as a result of cyberattacks or unauthorized third-party access.<\/li>\n\n\n\n<li><strong>Unlawful or Negligent Use<\/strong>: The unlawful, negligent, or fraudulent use of the platform, their private credentials, or the hosted content by the Users themselves, or any use contrary to this Legal Notice.<\/li>\n\n\n\n<li><strong>Third-Party Content and External Links:<\/strong> The opinions, reviews, portfolios, or statements expressed by full members or collaborators on the website. Likewise, the Academy is not responsible for the status, privacy policies, or content of websites linked through third-party hyperlinks (such as external festivals, social networks, or third-party portals). <\/li>\n\n\n\n<li><strong>Exclusion of Liability for Advice (Art. 4.6 and 15.f of the Statutes)<\/strong>: Given that the Academy may offer support, guidance, and advisory services regarding intellectual property, standard contracts, and licenses for its members, it is expressly stated that this information is provided for <strong>purely indicative, informative, and non-binding purposes.<\/strong> Under no circumstances does this support constitute a professional legal opinion, a formal legal consultation, or binding legal advice. The Academy shall not be liable for any legal, financial, or contractual decisions made by users or members based on these guidelines, it being the sole responsibility of the interested party to verify the information or hire an independent professional service.  <\/li>\n\n\n\n<li><strong>Indemnification<\/strong>: The User agrees to defend, indemnify, and hold completely harmless the Academy against any claim, demand, administrative sanction, damage, or cost (including attorneys' fees) arising from the improper use of the website, the infringement of third-party rights, or the breach of these legal conditions.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>6. Modification of the Conditions<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The Academy reserves the right to modify, update, or revise this Legal Notice and Terms of Use at any time, without prior notice, in order to adapt it to legislative or jurisprudential developments, or operational changes within the association.
